Your online-shopping experience shall be easy, fast, secure and framed to respect your rights as a consumer. Thus, to dispell doubts, here is a little dose of legal prose.

Shufflesome offers sticker outfits (the "Shufflesome Stickers") for iPods—with a focus on iPod shuffles, and provides its online-shopping site to you subject to the following terms of service.

Access and use of this shop is provided by Alexander Schneider (in this Agreement "Shufflesome" and "Alexander Schneider" are used interchangabely) to you on the condition that you accept these Terms of Service, and by accessing or using this shop, you agree to these Terms of Service. If you do not agree to accept and abide by these Terms of Service, you should not access or use this shop.

In addition, this Agreement contains terms related to general usage of this Website and to Shufflesome's services.

Shufflesome may revise and update these Terms of Service at anytime and without notice. You are cautioned to review the Terms of Service posted on the Website periodically. Your continued access or use of this Website after any such changes are posted will constitute your acceptance of these changes.

Intellectual Property

a) All sticker designs offered through this website and all associated artwork, trademarks or product names are owned by the respective artists or companies, to which they retain all rights, including title and copyright in and to the provided artwork. Text and materials on Shufflesome's Webpages that are derived from any contributing artist's original works are displayed according to the Shufflesome Artwork Supply Agreement.

b) The design template files are provided under a share alike provision. You may copy them, distribute them, make amendments to them and use them commercially, provided that you give attribution to Shufflesome and provide the same licensing terms after you release or produce any of your derivative work (share alike). Attribution requires you to make clear that the templates used to make your designs are originated by Shufflesome (do link back to http://www.shufflesome.com). The share alike provision requires you to adapt the same licensing terms and append a notice to your offer and any template files intended for reuse, that says: "This work is released under the Shufflesome licensing terms (http://www.shufflesome.com/terms/)".

c) All images, written information or files for download (including the organization and presentation of such material) on this Website (the "Materials") are the property of Shufflesome and its affiliates who provide these Materials to help create and feature the Shufflesome Stickers. These Materials and are protected by intellectual property laws including laws relating to copyrights, trade-marks, trade-names, internet domain names, and other similar rights.

d) Other materials contained in this site, such as written information and images, are property of Shufflesome and its affiliates and are protected by copyright. Should you wish to copy, distribute and display any contents from Shufflesome, you are encouraged to do so, given that you don't use it for commercial purposes. A link back to this site would be appreciated. Should you wish to modify, reproduce or transform the materials on this site, ask first. Inquiries should be made prior to the release of any material taken from this site.

If you have entered into an Artwork Supply Agreement with Shufflesome, the terms and provisions therein apply.

Apple, iPod, and Shuffle are trademarks of Apple Inc., registered in the U.S.A. and other countries. Shufflesome is not affiliated with Apple Inc.. All warranty and support for iPod Shufflesome Stickers offered through Shufflesome are handled by Shufflesome.

Your Privacy

We will never share your email address, your delivery address or any other part of your contact information or your credit card details or other information related to your payments with anyone. When you provide us with any such information, either through correspondence via the Website or via email, or during PayPayl transactions, we only use that information for dialogue with you, to confirm your order and to complete your purchase orders. We will not send you unsolicited email. When posting comments on the site, your email address and name are required. When adding your URL, this URL, and not your email-address will be used in the footer of your comment to link your name. Changes and updates of Website

Shufflesome updates the information on this Website regularly. However, Shufflesome cannot guarantee or accept any responsibility or liability for the accuracy, currency or completeness of the information on this Website. Shufflesome may revise, supplement or delete information, services and/or the resources contained in the Website and reserves the right to make such changes without prior notification to past, current or prospective visitors.

Payment and Shipping

We accept PayPal payments. During checkout, please make sure to include your address (tick the box under "Shipping Information"). Choose to pay using credit card, bank transfer or your PayPal account balance (if applicable).

We ship worldwide. All orders are shipped via Germany's Deutsche Post, in standard letter envelopes at the rates applicable either for letters within Germany, or from Germany to other european countries or from Germany to international destinations outside Europe.

Shufflesome cannot guarantee specific delivery times.

Prices

Prices are as stated on this Website and are subject to change at any time without notice.

Currency is EUR for orders within Europe and USD for orders outside Europe. Other currencies are accepted as well (the equivalent price in your currency will be determined by PayPal during checkout).

Prices include VAT for customer orders within the European Union (EU). Customers from outside the EU do not need to pay VAT. The price listed does not include customs fees or taxes that might apply in the countries of destination. If you are a company registered in the EU, with a valid VAT number, you may avoid paying the tax by writing us your VAT number before placing the order. Once your VAT number is verified (usually within 24 hours), the price for your order will be net of VAT. Unfortunatelly we cannot reimburse the VAT tax retrospectively. In special cases we may arrange a credit towards future orders.

Returns and Refund

You may withdraw your order and Shufflesome will refund you of all payments made within 30 days counted from the date the returned items are received. Simply send the items back, in a saleable condition, with proof of purchase to:

For orders within Europe, send the items back within 14 working days. For international orders outside of Europe send the items back within 21 working days. In both instances, the days are counted from the date the product is delivered to you. These terms and conditions do not affect your statutory rights as a consumer.

Warranties

Shufflesome does not represent or warrant that the Site, the Materials or the Shufflesome Stickers will meet your requirements or that their use will be uninterrupted or error free. In regard to the Shufflesome Stickers, Shufflesome does not provide any warranties that exceed those by the manufacturer of the vinyl foils used. The colors of the iPod shuffle sticker designs as displayed on your monitor may deviate slighty from the colors of the actual print results. Shufflesome therefore can not guarantee that the printed colors will match your preference. Shufflesome does not warrant that the iPod shuffle inclusive decals can be used trouble-free in combination with other products, such as a dock or other peripherals and devices.

Limitation of Liability

You assume all responsibility and risk for use of this website, the materials and the Shufflesome stickers, including without limitation any of the information contained therein.

In no event shall shufflesome or any of its partners or agents be liable for any incidental, indirect, punitive, exemplary, or consequential damages whatsoever (including damages for loss of profits, interruption, loss of business information, or any other pecuniary loss) in connection with any claim, loss, damage, action, suit or other proceeding arising under or out of these terms of service, including without limitation your use of, reliance upon, access to, or exploitation of this website, the materials or the shufflesome stickers, or any rights granted to you hereunder, even if we have been advised of the possibility of such damages, whether the action is based on contract, tort (including negligence), infringement of intellectual property rights or otherwise.

In any event, the total maximum aggregate liability under these terms of service or the use or exploitation of any or all part of this website, the materials or the Shufflesome stickers in any manner whatsoever shall not exceed thirty (30.00 EUR) Euros.

Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Indemnification

You agree to indemnify and hold Shufflesome harmless against all claims or liability asserted against Shufflesome arising out of or in connection with any breach by you or anyone acting on your behalf of any of these Terms of Service.

Making Claims of Infringement

Shufflesome respects the copyright of others, and we ask our Website visitors as well as the artists involved in the creation of Shufflesome Stickers to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please contact Shufflesome.

Communication issues

Shufflesome is not liable for any damages related to communications to or from this Website. This Website is controlled, operated and administered by Shufflesome from Cologne, Germany. This Website can be accessed from countries around the world. As each of these jurisdictions has laws that may differ from those of Germany, by accessing this Website, you acknowledge and agree that all matters relating to access to, or use of this Website shall be governed by the laws of Germany.

You also agree that any claims or disputes whatsoever arising hereunder shall be submitted to the exclusive jurisdiction and venue of the courts of Cologne, Germany and acknowledge that you do so voluntarily.

Shufflesome's failure to insist upon or enforce strict performance of any provision of these Terms of Service shall not be construed as a waiver of any provision or right.

If any provision or part thereof of these Terms of Service is wholly or partially unenforceable the parties or, in the event the parties are unable to agree, a court of competent jurisdiction, shall put in place thereof an enforceable provision or provisions, or part thereof, that as nearly as possible reflects the terms of the unenforceable provision or part thereof.
